In this regard, the learned counsel appearing for the respondent relied on the Judgment of this Court in Pavayammal & Anr. Vs. Muthusany Gounder & Anr., reported in (1997 (3) L.W 789) and made a submission, as according to Order 38, Rule 9, the interim attachment made in the application filed under Order 38 Rule 5 cannot survive after dismissal of the suit. In the Judgment relied on by the respondent's side counsel, this Court, in paragraph No.12, has held as follows:-
