I may also refer to the decision of the Allahabad High Court in Choti v. Khecheru ILR 42 All 649 : AIR 1920 All 177 (2), in which the question related to the legality of the sanction granted under Section 195 Crl.P.C. By the application of Section 12 Crl.P.C. it was held that the mere fact that the Magistrate of the First Class was transferred to some other sub-division, did not deprive him of the power to continue the proceedings already initiated under Section 195, while he was functioning previously in some other sub-division, and that the powers and jurisdiction of the Sub-Divisional Magistrate extended throughout the district of Meerut.
