In the case of Special Land Acquisition Officer v. Karigowda [AIR 2010 SC 2322], upon which much reliance was placed by the learned counsel for the claimants, the Honourable Supreme Court has held that sale instances of adjacent villages can be made the basis for determining the fair market value and the power of compulsive acquisition has an inbuilt element of duty and responsibility upon the State to pay the compensation which is just, fair and without delay. Thus, it will be appropriate to apply the rule of plain interpretation to the provisions of this Act. The relevant paragraph of the above said judgement reads as follows:
