In view of clear pronunciation of this Court in
G.Somashekar's case referred to supra and the Hon'ble
Supreme Court in Swaminathan's case referred to supra, no
useful purpose would be served by referring to the other
judgments relied on by learned Counsel on both side. Under
such clear facts, this Court does not find it appropriate to
remand the matter to drive the parties for another decade of
litigation.
