In Baladin v. Mst. Ram Piarey, 1952 All LJ 623=(AIR 1952 All 977) (FB), a certain property was sold under the Act, although the landlord has claimed only a half share in it in his written, statement under Section 8. It was held that a suit for a half share was maintainable by the true owner thereof, for the Special Judge had no jurisdiction to show this share in the list under Section 19 (2). The case is distinguishable on facts from the present one.
