In case of any error or irregularity which has
occasioned failure of justice and where such objection
regarding the validity of sanction was raised in the Trial
Court, as such the Special Judge had made an observation in
the impugned judgment by placing reliance in the case of
Ramaswaroop Rathore Vs. State of Madhya Pradesh
(2000 Criminal Law Journal 1882) and in the case of
State of Orissa Vs. Mruthyunjaya Panda (1988 (1)
Crimes 109 SC).
