First, that the accused must be in the custody of a police officer,
Secondly, the accused must have given an information to the police
(the exception contemplated by Section 27 of the Act is that even
though this information may amount to a confession),
Thirdly, there must be discovery of an instrument and,
Fourthly, information must relate directly to the fact discovered
