In the case of Atul Mishra Vs. State of U.P.6, while deciding the bail application of the accused, who had committed the offence under the POCSO Act, the Court noted that the victim and the accused knew each other from school, had eloped, and been staying with each other for a few years. They even had a child together out of the said relationship, clearly indicating that the relationship shared by them was consensual. In Atul Mishra v. State of Uttar Pradesh passed in Crl. Miscellaneous Bail Application No. 53947 of 2021 decided on 25th January, 2022, the Allahabad High Court while deciding the bail application of the accused charged for an offence under the POCSO Act, noted that the victim and the accused knew each other from school, had eloped and were staying with each other for a couple of years and that they even had a child from the said relationship, clearly indicating that the relationship was consensual.
