47. We also rely on the decision of the coordinate bench of this
Tribunal in the case of Sicpa India (P.) Ltd. (supra) wherein it
has been held that the subsidy received by the assessee in
form of excise duty exemption for setting up new industry in
the North Eastern State viz., Sikkim was in the capital field
and therefore not liable to tax under the provisions of section
115JB of the Act.
