In view of the law laid down by this Court as well as by the Honble Supreme Court, I am unable to persuade myself to the view taken by the Orissa High Court. The judgment of the Orissa High Court is not applicable to the facts of the present case as the grievance of the petitioner is that the court below ought to have recorded reasons for rejecting the application filed by the petitioner and not that the said application has been rejected at the stage prior to hearing of the appeal.
