10. He also drew attention of the Court to the Bench
decision of this Court in MANU/WB/0279/2009
(Munmun Ghosh v. Tarun Kumar Malik). It was ruled
therein that the allegation that the marriage between
the parties was not consummated cannot be proved
by giving any positive evidence and even if the Court
is inclined to satisfy itself, the petitioner cannot be
expected to prove her assertion except by her oral
evidence.
