On the other hand, Mr. P.P. Singh, the learned Counsel on behalf of Reserve Bank of India, has submitted that the case of the petitioner is covered by (iv), as the petitioner being a firm, has no independent entity and since the loan was availed by the partners of the firm and Mr. Raghurai Tamba, having been an ex-Director of the respondent/Bank, the petitioner was not entitled for the benefit of the said OTS Scheme. Mr. P.P. Singh has also submitted that the refusal to grant the benefit of the said Scheme cannot be enforced in writ jurisdiction and has placed reliance on Sardar Prem Singh v. Bank of Baroda III (2004) BC 455, and unreported judgments in the case of Veraval Mercantile Co-op Bank Ltd. v. Reserve Bank of India, Special Civil Application No. 14061/2005, decided by Gujarat High Court on 29.12.2005, and Navalkishor Bagmal Agarwal v.
