The Hon'ble Madras High Court while dealing with a case
of C. Manoharan vs. C.V. Subramaniam & Ors., reported in
2006 (4) SCC MLJ 898it has been laid down therein by taking
into consideration the judgment rendered by Hon'ble Apex
Court in the case of P. Jesaya vs. Sub-Collector (supra) that
the decree passed against the death person cannot be treated
as nullity rather it can be construed as nullity.
