14. It It is submitted that the Commissioner of Survey, while incorporating
the subject land as Waqf property after having issued notices to the
concerned parties, such as the petitioner, as they were in possession,
the said report of the Commissioner and the subsequent notification
would have to be set aside. It is submitted that this Court set aside said
proceedings in the matter of Vanka Thrimurthulu Vs. District
Collector and District Magistrate, East Godavari District, Kakinada

and others12, whereby the notification of the Waqf Board was set aside
as notices to the people in possession of the properties was not issued
and their objections were not considered.
