The
decision in the case of Mohd. Zulfikar Ali (supra) cited by the
learned counsel for the appellant is also distinguishable as it was a
case under the Workmen Compensation Act, 1923, wherein the
definition of „workman‟ provided in Section 2(n) of the said Act was
entirely different, to mean "any person other than a person whose
employment is of a casual nature and who is employed otherwise than
the purposes of the employer's trade or business".
