6. Ld. Counsel for the appellant during arguments has
reiterated the above mentioned grounds of the application for
condonation of delay. Reliance has been placed on a judgment in a
case titled Delhi Development Authority v. Dalip Kumar 137 (2007)
DLT 309 wherein it has been held that refusal to condone delay can
result in meritorious matters being thrown out at very threshold and
cause of justice being defeated. It has been further held that when the
delay is condoned, highest that can happen is that cause would be
decided on merits after hearing parties. There is no dispute as to this
proposition of law.
