Before closing, one point arises for consideration and that is whether the decisions of the Supreme Court in Escorts [1986] 59 Comp Cas 548 and Swadeshi Polytex [1985] 58 Comp Cas 563 should be treated as binding precedents. The question what a binding precedent is has been dealt with in the decision in A. Aziz v. Managing Director, KSRTC [1986] ILR Kar 2007.
