A perusal of the case law on this would show that, for instance, in the case of Advocates admitted for practice, the disability under the existing provision under Section 24A of the Advocates Act, 1961, is applicable only for a period of two years. However, the Supreme Court in the case of Mahipal Singh Rana (supra) and the Gujarat High Court in the case of C v. Bar Council of Gujarat (supra) recommended for more stringent measures. Even the Law Commission of India, in its 266th Report, has suggested removal of the two-year period and, in fact, recommended for a total ban in the cases of those persons who are convicted of offences involving "moral turpitude" from being enrolled in the profession or from practicing as advocates.
