13. The law laid down by the Apex Court while considering Sections 15 and 22 of the Industrial Disputes Appellate Tribunal) Act, 1950 in the above case are as follows viz., (i) when there is a want of good faith, (ii) when there is victimisation or unfair labour practice, (iii) when the management has been guilty of a basic error or violation of a principle of natural justice, and (iv) when on the materials, the finding is completely baseless or perverse. The judgment cannot be read as taking any contrary view over the judgment in Caltex (India) Limited case.
