Although as discussed above, the case of Shahjade (Supra) was decided on the facts and circumstances of the aforesaid case and therefore is clearly distinguishable, however, any other view would render the aforesaid judgment per incuriam inasmuch as the statutory rule and regulations, amendment in the Act as well as the exposition of law in catena of cases, referred to above has not been noticed by this Court and it cannot thus be said to be a binding precedent.
