10. This Tribunal also considered the case of applicants basing on
amended rules and alternative criterion of eligibly of promotion on due
date i.e. 01.01.1975, when applicants completed ten years because the
rules were amended in 1979 with retrospective effect. We find that
similar question came up for consideration before this Tribunal in OA
No. 213 of 2007 filed by similarly situated employee styled Natabar
Mohanty vs Indian Council of Agricultural and, after discussing all pros
and cons of the matter, this Tribunal dismissed the OA on 2 nd
December, 2019, an excerpt from it reads as under:
