40. Unison's case is principally founded on an order dated
27.04.2015 passed by the Supreme Court in Unison's SLP (SLP No.
12084/2015). Mr. Wadhwa earnestly contended that on 27.04.2015, the
Supreme Court had granted Unison an opportunity to file its Statement
of Defence within a period of three weeks of the said order, but Unison
was effectively prevented from doing so, as the Arbitral Tribunal had
heard the matter and reserved the award without waiting for Unison to

Wadhwa, would fall within the scope of Section 34(2)(a)(iii) of the
