The Executive Magistrate cum Revenue Divisional Officer, Coimbatore South, Coimbatore [Crl.R.C.No.806 of 2019 of this Court dated 25.11.2019] for the proposition that once a Civil Court case is pending with regard to the ownership and occupation, the Civil Court's order is only binding. Hence, in view of the same, initiation of proceedings under Section 145 Cr.P.C., ought not to be entertained.
