In view of the specific clause contained in the policy and in view of the above said decision in C.M.A(MD).No.552 of 2017 dated 12.10.2017 in the case of The Manager, United India Insurance Company Limited Vs. Saranya and others, I have no hesitation to hold that the Insurance Company is not liable to pay the compensation, since the nature of the injury is not covered under the policy (Ex.R1). Accordingly, this Civil Miscellaneous Appeal filed by the Insurance Company is allowed and it is open to the claimants/petitioners to make a claim from the owner of the vehicle.
