4.22 In Vishesh Films Pvt. Ltd. v. Super Cassettes Industries Ltd., 2024 SCC OnLine Del 6117, this Court held that Hindi word 'Aashiqui' (meaning romance / love) for a film was not generic but a suggestive mark that could be protected as it did not exhaustively describe the film's full narrative. Accordingly, the title 'Tu Hi Aashiqui'/ 'Tu Hi Aashiqui Hai' was found deceptively similar to 'Aashiqui' because of phonetic and conceptual similarities and the likelihood of confusion / misleading the public. 4.23 In view of the above, the Plaintiff is entitled to injunctions as prayed for in this Application.
