In the case of Bamnarain Sahu v. Mt. Makhna, I. L. R. 1939 ALL. 680 : (A. i. R. (26) 1939 P. C. 174), their Lordships of the Judicial Committee held that if a coparcener, or if he is under a disability, any person entitled to act for him, demands a separation of his share in a pending suit for partition, there is a severance in status even though no relief is granted by the decree.
