In Latif vs. State of Haryana and others, 2016 (1) RCR (Civil) 196, a Division Bench of this Court was examining the provisions of Section 7 of the Haryana Panchayati Raj Act, 1994. The issue was with respect to the bifurcation of the existing Gram Sabha areas and the decision making process. It was held that even if, there is no resolution for bifurcation of a Gram Panchayat and a decision is taken by the State Government under Section 7 (1) of the Act, the Gram Panchayat can be bifurcated. In that case, no resolution for bifurcation was passed by the 5 of 7 ::: Downloaded on - 10-08-2022 00:21:43 ::: CWP No.14793 of 2019 -6- existing Gram Panchayat.
