In a decision of the Hon'ble Supreme Court rendered in the case of Birpal Singh v. State of U.P., reported in AIR 1977 SC 2083, trial Court had acquitted all accused persons but the High Court reversed order of acquittal in respect of four accused persons. It was observed that if prosecution story is found doubtful in respect of three other accused persons, their conviction is liable to be set aside.

Beerpal vs The State Of Madhya Pradesh on 31 October, 2014

Prayer for bail was made on the ground that as per allegation made, murder of Maharaj Singh was committed by co- accused Devi Lal though at that time present applicant was also present on the spot but no overt act was assigned to him in (Birpal Vs. State of M.P.) 2 M.Cr.C. No. 9604/2014 commission to the offence of murder. The only allegation made against the present applicant is that dead body of Maharaj Singh was thrown in the well in order to disappear the evidence. Charge-sheet has been filed.
