Thereafter, the Ordinance governing Under- graduate evaluation of answer-scripts 2019 was promulgated on 29th March, 2019 and the said 2019 Ordinance was questioned before this Court in the case of SRI NEELESH MEHTA v. RAJIV GANDHI UNIVERSITY OF HEALTH SCIENCES AND ANOTHER in Writ Petition No.31335 of 2019 and connected matters and this Court, by order dated 18th August, 2020, quashed the 2019 Ordinance and in the meanwhile, the Medical Council of India 22 amended its Regulations from the Academic Year 2019-20, as discussed above. Thereafter, the Ordinance governing valuation of answer-scripts of MBBS course (RS-III Scheme) promulgated on 13th October, 2020 was extensively considered with regard to digital valuation system relating to the answers in the nature of multiple choice, and directed the Universities to adopt the system of 'Model Key Answers' in all the examinations of all the courses. Further, as this Court quashed the Ordinance notified on 13th October, 2020, thereafter, the new Ordinance was promulgated on 01st February, 2021 by the respondent- University governing 'Central Assessment Programme' for theory assessment of MBBS Course as per the amended provisions under MCI Act. This Court, by order dated 07th October, 2021 passed in Writ Petition No.13626 of 2021 and connected matters (MS. SAHANA KALASAGOND AND OTHERS) quashed the Ordinance dated 01st February, 2021 and as such, directed the respondent-University to apply the provisions of the Ordinance of 2012.

2. Learned Counsel Sri N.K.Ramesh, appearing for the respondent-University submits that in the case of Sri Neelesh Mehta (supra) the grievance of the medical students were under consideration. The learned Counsel submits that although several grounds were raised, the co-ordinate Bench of this Court proceeded to strike down the Ordinance only on the ground that the provisions governing the conduct of examination with respect to the Under Graduate courses and Post Graduate courses of the -4- medical stream arises out of a provision of the MCI Regulations and therefore, there could not be two sets of standards, one governing the Under Graduate courses and another for the Post Graduate students. However, it is submitted that the entire context in which the co-ordinate Bench in the case of Sri Neelesh Mehta considered the Ordinance of 2019 is the discrepancy in the matter of medical students and nowhere in the judgment is the case of the Dental students or other disciplines is considered. It is therefore the contention of the learned Counsel for the respondent-University that the doctrine of severability should be applied in this case and this Court should hold that the decision of the co-ordinate Bench in quashing the Ordinance of 2019 is applicable only to the medical students and not to the Dental students, as in the present case.

In his support of submission, he invokes the doctrine of -5- NC: 2024:KHC:12954-DB WA No. 1018 of 2023 C/W WA No. 1059 of 2023 WA No. 1061 of 2023 severability and tells that as against students other than of MBBS course, the Ordinance survives, notwithstanding the term "quashing the impugned ordinance in its entirety" employed in the said judgement. He hastens to add that the petitions wherein the said Ordinance has been quashed, belonged to non-MBBS students.
