20. So far as the judgment relied upon by the learned counsel for
the claimants in the case of Holu Ram Nishad & another Vs. Ishak
Mohmmed & others, 2004 (2) CGLJ 351 is concerned, the factual
matrix in the said case itself would clearly distinguish it from the facts
of the present case. In the said case, while the materials loaded in
the truck the accident occurred which clearly gives a causal
connection of the use of the said vehicle and the accident arising from
the use of the vehicle. Hence, the said judgment is distinguishable on
its facts itself.
