the said judgment Hon'ble Justice S.P.Barucha (as he then
was) has considered the provisions of section 351 of the
BMC Act vis-a-via the obligation of the commissioner or the
authority delegated such power to demolish the
unauthorized construction. Barucha, J. held thus:-
