In Harnam Singh vs. The State of U.P. (supra), the question of abetment on death of appellant was considered by Hon'ble Apex Court under provisions of Section 431 Cr.P.C., 1898, which was statutory in pari materia with Section 394 Cr.P.C., 1973, wherein Hon'ble Apex Court held that the widow of the deceased-appellant may be brought on record on death of the appellant as his legal representative and is entitled to continue the appeal as the sentence of fine directly affects the property, which would devolve on her on the death of her husband.
