7. We otherwise tend to agree with the learned Single Judge. The writ
petitions were undoubtedly filed long after issuance of demand-cum-
allotment letters and without any explanation for the delay. The demand-
cum-allotment letters issued, required acceptance within 30 days payment
thereunder to be made maximum within three months and clearly informed
that upon payment not being made, allotment shall stand automatically
cancelled. The appellants did not even accept the allotments and cannot
claim thereunder. Had the appellants been genuinely concerned about the
price, they would have deposited with the DDA at least the admitted price
or would have availed of the allotment reserving their right to challenge the
price. The belated representations and the writ petitions were clearly an after
though. The law in this regard has been exhaustively discussed by a
Division Bench of this Court in Sudhir Kumar Sharma v. DDA 119 (2005)
DLT 13.
54. The market value is fixed by this court in the case titled
"Sudhir Sharma Vs. UOI/DDA" bearing LAC No. 97-A/2006 vide
judgment dated 03-03-2008 involving the same award
No.26/2002-03 of village Bharthal. Hence in the present case as well
the market value of the land situated in village Bharthal be assessed
after giving appreciation @ 12 per cent per annum for a period of about 8
months 13 days, total 257 days to arrive at just and fair market value of
the acquired land. Accordingly by taking base value @ Rs.13.82 lakh per
acre in block "A" and Rs.12.32 lakh per acre in block "B" on 01.04.2000
and by giving appreciation of 12 per cent per annum for a period of 257
days, the market value of the acquired land would be Rs.14,98,769/- per
acre in block "A" and Rs.13,36,095/- per acre in block "B". It is rounded
off to Rs. 15,00,000/- per acre in Block "A" and Rs. 13,36,000/- per acre in
Block "B". Hence, the fair market value assessed of the acquired
land on 13.12.2000 is Rs. 15,00,000/- per acre in block "A" and
Rs. 13,36,000/- per acre in block "B". Both the issues are decided
accordingly.

decided accordingly.
