11.The learned counsel for the appellant had further relied upon
the Judgment of our High Court reported in (2001) 1 LLJ 309 (Soft
Beverages (P) Ltd., Vs. E.S.I.Corporation, Madras to impress upon the
Court that the loadmen coming along with lorry and leave the premises
after unloading was rejected in the said appeal. He had further contended
that even engagement of self employed loadmen occasionally would
attract the provisions of the Act. Therefore, according to the learned
counsel for the appellant, the E.S.I.Court ought not to have set aside the
order under the head of loading and unloading charges.
