5. In the present case in hand, also there is nothing on record to indicate that report of the public prosecutor was sought for by the learned Special Judge, Cachar, Silchar. The said learned Court below merely relied on the departmental petition. There is nothing on record to indicate that notice to the accused was given before the order against his interest has been passed. It is seen that in the above cited case of Jayanandan Prasad (supra), this Court place reliance in the case of Sanjay Kumar Kedia vs Intelligence Officer, NCB & Anr. (20009) 17 SCC 631, wherein the said principle had been laid down.
