16- We find some force in this submission of the petitioner. When the petitioner was acquitted on 8.2.2005 and when he submitted a representation on 21.2.2005, the respondents should have decided the representation in accordance to law within a reasonable time of atleast three months. Keeping the matter pending for a period of more than a year and three months was not appropriate. In that view of the matter, we are of the considered view that after his acquittal on 8.2.2005, petitioner is entitled to be treated as reinstated in service and granted the consequential benefit of arrears of salary after a period of three months of his submitting the representation on 21.2.2005. 86. It was submitted that on the date of publication of the said seniority list dated 04.06.2002, only one Court case was pending namely, Shri Santosh Kumar Shukla vs. Union of India vide W.P. (C ) 3519/1999 before the Honble Delhi High Court, and, therefore, the seniority list as notified was actually final, and had been termed as provisional only for the purpose of the outcome of that Court case, and when the W.P. (C) No.3519/99 was dismissed by the Honble High Court, that so called provisional seniority list dated 04.06.2002 automatically became the final seniority list (Contention No.35).
