Apropos the contention of the petitioners that there is automatic transfer of all such suits from the Court of the Civil Judge (S.D.) to the Court of the Civil Judge (J.D.), it is required to be noted that in the case of Rathod Bhojaji v. Pathan Nasirkhan 1962 GLR 803 and also in the case of C. C. Basu v. Patel Dahyabhai Vaghjibhai 1967 GLR 123 this Court has held that a Joint Civil Judge, either Senior Division or Junior Division, can only dispose of such matters as are referred to him either by the Principal Judge of the Court to which he is joint or by the District Judge of the District in which such Court is situate.
