In another judgment of our
Hon'ble High Court in WP No.15209/2015 dated
21/10/2020 (Gangamma v/s Rangaiah), the Hon'ble High
Court has relied on the above decision and held that the
proviso to Section 49 states that an unregistered document
can be received as evidence of any collateral transaction not
required to be effected by registered instrument and therefore
unregistered document can be received as evidence of any
collateral transaction which by itself is not required to be
effected by means of a registered instrument.
