Learned counsel for the plaintiff has relied upon the judgment of this court passed in the case of Akhilesh Kumar Verma vs. Maruti Udyog Ltd. & Ors., CS(OS) 1917/1995 dated 26.09.2011, where he submits that despite termination of the services of the employee, a decree of damages for Rs.15lakhs was passed as the dismissal of the employee from services was found to be illegal. The court further held that though the employee cannot be entitled to back wages as a matter of right but a suitable compensation can be awarded in the facts and circumstances of the case.

55. Normally, in view of a breach of contract compensation for humiliation and harassment would not be awarded. However, in my opinion, this would be an exceptional case. A reference in this regard may be had to a judgment of this High Court in the case of Akhilesh Kumar Verma vs. Maruti Udyog Ltd. & Ors., MANU/DE/3812/2011 : 2011 IX AD (Delhi) 90 . That suit was filed by a plaintiff who was employed as an Executive. He sought apart from other reliefs, amounts towards harassment, mental agony and defamation. This court held as follows:--

Further in K.L Sehgal's (supra), the damages for un expired period as per terms and conditions of retainership agreement was granted, but in present case there is no such unexpired period as per appointment letter (Ex. PW1/B).bThe plaintiff had further placed reliance on Akhilesh Kumar Verma (supra), wherein the defendant Co. in violation to agreed terms initiated departmental inquiry, thus termination on basis of same was held illegal and consequently compensation was awarded and in Adobe Systems (Supra), the concept of damages was explained so as to compensate as to loss and damages and to have deterring effect on the society so as to prevent perpetration of wrong in future. Thus the decisions are not applicable to the facts of the present case.
