8. Learned counsel for the plaintiff has relied upon the judgment of this
court passed in the case of Akhilesh Kumar Verma vs. Maruti Udyog Ltd.
& Ors., CS(OS) 1917/1995 dated 26.09.2011, where he submits that despite
termination of the services of the employee, a decree of damages for
Rs.15lakhs was passed as the dismissal of the employee from services was
found to be illegal. The court further held that though the employee cannot
be entitled to back wages as a matter of right but a suitable compensation
can be awarded in the facts and circumstances of the case.
