The learned counsel for the respondents have also invited my attention to a Division Bench judgment of this Court in Ganesh Dutt and Ors. v. The State of Haryana and Ors.,2001(2) I.L.R. (P&H) 122, where it was observed that if it is established that a company does not perform a public duty, in such a situation such company cannot be held to be an instrumentally of the State or any authority for the purpose of Article 12 of the Constitution irrespective of the fact that Government holds 50% shares.
