28. The case of Maqsood Ahmad (supra), is also
wholly inapplicable to the present case inasmuch as, the
said case pertains to a peon appointed and transferred to a

college who was un-authorisedly absent and pursuant to
an enquiry conducted in respect of other charges also, it
was held by the Nagar Ayukta that the Petitioner was
guilty and his pay was reverted to his basic pay and was
issued a warning. The order of the Nagar Ayukta was
interfered with by the High Court on the ground that the
explanation of the Petitioner ought to have been
considered sympathetically.
