41. Although the law laid down in the aforesaid
case of S. Ramasamy (supra) cannot be denied, it is
obvious that the facts of the said case are distinct
inasmuch as the very performance of the applicant
therein was at stake and without giving any
opportunity to him of showing improvement, he was
transferred. In the peculiar facts and circumstances
of that case, his transfer was set aside, since held
to be by way of punishment to him, which is not so
in the present case.
