The Patna High Court in the case of Dinesh Kumar Yadav (supra) taking into consideration the relevant provisions, namely, Sections 96 and 117 of the M.V. Act. 1988 and Rules 187, 191 and 214 of the Rule, 1994, gave similar finding and held that the Regional Transport Authority is only competent to designate a bus stand and the District Magistrate is empowered to identify parking zone/places.

11. Learned Counsel for the petitioner has placed reliance upon a single Judge's judgment of this Court in the matter Dinesh Kumar Yadav v. State of Bihar 1999 (3) PLJR 130. In paras 14 to 17 the learned Single Judge has observed that parking/bus stop in a city/town is undisputedly different from a bus stand. The learned Judge observed that the District Magistrate cannot designate a bus stand and prescribe fees for its use. It was also observed that Rule 191 empowers the traffic authority to designate a bus stand and to prescribe fees etc. Being in respectful agreement in the above judgment I hold that Zila Parishad has no authority or jurisdiction to designate a particular place as bus stand. If they cannot designate a particular place as bus stand they certainly cannot auction the right in favour of a third party for collection of fees etc. It is made clear respondent-Zila Parishad would have no authority to auction the bus stand unless a particular place is earmarked or is so designated by Regional Transport Authority as halting station/bus stand.

5. On hearing counsel for the parties and on going through the writ petition and the counter-affidavit, this Court finds that both the objections are well founded and are fit to be accepted. The impugned order is accordingly set aside. But following the decision in the case of Dinesh Kumar Yadav (AIR 1999 Patna 213) (supra) the Regional Transport Authority is directed to designate a Taxi stand at Bakhtiyarpur. It is expected that the Authority will take appropriate steps in accordance with law and pass necessary orders expeditiously. Needless to say that the stand will be designated in the manner as provided under Rule 191 of the Bihar Motor Vehicle Rules, 1992, i.e. either by notification in the official gazette or by erection of traffic signs as indicated in the rule.
