Reliance is also placed by the Counsel for the respondent upon a judgment of the this Court in the case of Hari Sharan Singh and another vs State of U.P. and others; decided on 13.02.2023 in Matters Under Article 227 No.5156 of 2022, wherein, this Court after following the judgment of Delhi High Court in the case of Smt. Shatni Devi and another vs State and others; AIR 1982 Delhi 453, has held as under:
