[8.6] In the case of Ismail Ibrahim Pandoor (Supra), the Division Bench
of this Court has observed and held that where there is an agreement
pursuant to which the possession has been handed over and on making a
part payment, the case would be covered by section 11(2) of the Act and
therefore, the reference under Section 18 of the Act would not be
competent. It is further held that a reference under Section 18 of the Act
would be maintainable and/or competent only against the award
declared under Section 11(1) of the Act.
