Despite, this the respondents did not woke up and kept on placing reliance on said decision to reject the claim of the pensioners / retirees 7, A similar claim has been allowed by this very Bench of the Tribunal in O.A. No. 060/00928/2018 titled J.K, KAPOOR VS. UNION OF INDIA & OTHERS, decided on 15.10.2018, and number of other cases as well.
