At the end, learned counsel for the petitioners contended
that, when the appeal is pending before the Income Tax Appellate
Tribunal, the proceedings in criminal case cannot be continued
and the Court shall grant stay of all further proceedings in
C.C.No.200 of 2016 on the file of Special Judge for Economic
Offences at Hyderabad, till disposal of the appeal and placed
reliance on M/s Cubex Tubings Limited and others v. The
Assistant Commissioner, Legal Customs (referred supra).
