The other Judgment which was rendered by a Learned Single Judge in the case of Smt. Banalata Sahoo v. State of Orissa and Ors. reported in 92 (2001) CLT 136 also records in paragraph 3 at page 1 39 of the report that arbitration clause was specifically deleted. But as noted above, the factual position in this case is not the same. Therefore, both the decisions have no application to the facts of this case.
