8.1 So far as the decision of the Coordinate Bench of this Court
in Patel Jayantibhai Mafatlal (supra) is concerned, in the said
case, it is observed by the Court that the complainant had
succeeded in discharging the burden that there exists a legally
enforceable debt or liability, whereas, in the case on hand, the
complainant has failed to prove the legally enforceable debt and
accordingly, the said decision would be of no help to the
