In Oriental Fire and General Insurance Co. Ltd., Chandigarh v. Smt Beasa Devi and Ors. it has been held that the insurance company can be saddled with the liability under Section 92A of the Act as soon as the Tribunal comes to the conclusion that the insured vehicle was involved in the accident and the correctness of other objections by the owner or the insurance company should be decided later on.
